These terms apply to the use of this website and to enquiries and services provided by Water Damage Hamilton.
Website use
Content on this website is provided for general information about water damage restoration and is not a substitute for an on-site assessment of your property. Conditions vary, and decisions about your building should be based on an inspection.
Enquiries and service requests
Submitting a form or calling us creates an enquiry, not a binding service agreement. Work proceeds once scope has been discussed and confirmed with you or, where applicable, with your insurer.
Estimates and scope
Estimates are based on conditions observed at the time of assessment. Concealed damage discovered during the work may change the scope, and any such change will be communicated before it proceeds where circumstances allow.
Scheduling and access
Response and completion times depend on access to the property, safety conditions, weather, availability of trades and the drying behaviour of affected materials. We do not guarantee a specific completion date.
Insurance claims
We document conditions and the work performed and can provide that documentation to you or your adjuster. We do not adjust claims, determine coverage or guarantee any claim outcome; those decisions rest with your insurer under the terms of your policy.
Payment
Unless agreed otherwise in writing, payment for services is the responsibility of the property owner or authorised representative, including any amounts not covered by insurance.
Limitation of liability
To the extent permitted by law, our liability is limited to the value of the services provided. We are not responsible for pre-existing conditions, damage arising before our attendance, or losses caused by delayed reporting or restricted access.
Governing law
These terms are governed by the laws of the Province of Ontario and the applicable laws of Canada.
